HURLEY - A Hurley man may have no criminal record of committing a sexual assault, despite the exchange of bodily fluids according to the victim and a no contest plea to a third-degree sexual assault felony charge. Yesterday, in Iron County Circuit Court in Hurley a plea and sentencing hearing was held in a case regarding an incident where an exotic dancer reported she was sexually assaulted by Brandon Frazer while working at Shooter’s Bar in Hurley’s lower block back on Sep. 6th of last year, an incident that was captured on camera. In the criminal complaint filed against Frazer, the charge was listed as third-degree sexual assault, which is a felony. However, the court did not find facts supporting that charge in its preliminary hearing and amended the charge to fourth-degree sexual assault, a misdemeanor. A plea agreement was accepted yesterday, which amends the charge back to third-degree sexual assault. The agreement defers judgment for a year, and if Frazer follows the stipulations of the agreement, the charge would be amended to disorderly conduct. Frazer accepted the agreement and pleaded no contest to the third-degree sexual assault charge. The victim in the case said in a victim impact statement that she doesn’t agree with the agreement saying in part that sexual assault is often normalized for dancers and many do not report it.
